Terms of web sale
Raw Studios terms of sale shall apply to all online contracts for the purchase of goods by you (client) from us (the seller - Raw Studios), to the exclusion of all other terms and conditions which you may purport to apply under any sales offer or purchase order.
Placing an order
All orders are subject to acceptance and availability. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the payment method or debit/credit card used to place your order. Once you have placed an order with Raw Studios, you will receive an order confirmation email acknowledging receipt of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it and are processing it.
We reserve the right not to accept your order in the event that the items ordered are out of stock or do not satisfy our quality control standards and are withdrawn by us Raw Studios. This mean that in a multi item order all parts may not be available.
Exchanging & Returns
Regulations of replacing or returning goods as per the executive regulation of the law of Kuwait no. 2014/39 regarding consumer’s protection:
To return and exchange and invoice is required.
-The consumer shall have fourteen days from the purchase date, the right to replace or return goods and recover the paid price as credit or refund thereof.
-The goods should be in the same condition when purchased, suitable to be resold, displayed and in its original package with all its accessories.
-The consumer did not use the goods thereof in whatever way.
-The goods nature couldn’t be returned or recovered.
-Gift item offered to customers at the time of the purchase should be returned is sealed packing with full accessories.
The consumer cannot return or exchange of the goods in the following events:
-If the consumer was aware of the defect of malfunction, existing already in the goods at the time of the purchase, and accepted it as is, or it was the last piece displayed in the store and this fact was stated in the invoice.
-If the specifications, packaging of the goods or the commodities would prevent exchanging or returning it whether damaging the goods or the impossibility of returning it to the condition of purchase, in a way that would prevent reselling it when the goods was damaged or couldn’t be returned to its original condition.
-In the event that the consumer misused, damaged or wrongfully installed the goods damaged.
-If the condition of goods or equipment cannot be displayed again, or there are missing accessories, components with or without carton, with torn package, provided that it should be in same condition when it was purchased by the consumer.
Disputes
In the unlikely event that there is a dispute in relation to the goods supplied, any dispute or claim shall be governed and construed according to Kuwait's Government Law and shall be subject to the exclusive jurisdiction of the Kuwaiti Courts. If any provision of these Terms & Conditions is held by any Court or other authority to be invalid or unenforceable in whole or in part, then the validity of the rest of these Terms & Conditions and the remainder of the provision in question shall not be affected thereby.
Data protection and Privacy policy
By using this website, you consent to us:
1. Passing your delivery address and phone number to our courier in case they need to contact you directly if there is a problem with your delivery.
2. Contacting you by email or phone in relation to you having placed an order or made an enquiry.
Debit and credit card details are checked and verified by a third party (Tap). To ensure that your debit, credit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency, which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly.
We may use information concerning you for payment recovery or to investigate any possible fraud in the event that debit or credit card payments have been used in a fraudulent manner. Please note that we may be required to disclose information concerning you if requested to do so by the authorities.
Trademarks and Copyrights
All intellectual property rights, whether registered or unregistered in the Website, content on the website and all the website designs, including, but not limited to, text, graphics, software, photos, video, music, sound, their selection and arrangement, also all software compilations, underlying source code and software shall remain Raw Studios' property. The entire content of the website are as well protected by copyright as a collective work under The State of Kuwait copyright laws. All rights are reserved to/under Raw Studios'.
